Sulh Ceza Mahkemesince verilen 11.06.2014 tarihli ve 282-664 say\u0131l\u0131 h\u00fckm\u00fcn, Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan temyiz edilmesi \u00fczerine dosyay\u0131 inceleyen Yarg\u0131tay 3. Ceza Dairesince 10.09.2015 tarih ve 9867-25151 say\u0131 ile;<\/p>\n\n\n\n<p>&#8220;&#8230;Ma\u011fdurun soru\u015fturma a\u015famas\u0131ndaki beyan\u0131, anlat\u0131m\u0131 ile uyumlu doktor raporu kar\u015f\u0131s\u0131nda yetersiz gerek\u00e7e ile san\u0131\u011f\u0131n \u00fczerine at\u0131l\u0131 su\u00e7la ilgili mahk\u00fbmiyeti yerine yaz\u0131l\u0131 \u015fekilde beraatine karar verilmesi,&#8221; isabetsizli\u011finden bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n\n\n\n<p>6545 say\u0131l\u0131 Kanun&#8217;un 84. maddesiyle 5320 say\u0131l\u0131 Kanun&#8217;a eklenen ge\u00e7ici 6. maddenin 1. f\u0131kras\u0131 uyar\u0131nca sulh ceza mahkemelerinin kald\u0131r\u0131lmas\u0131 nedeniyle bozmadan sonra yarg\u0131lama yapan Ankara 38. Asliye Ceza Mahkemesi ise 08.12.2015 tarih ve 749-926 say\u0131 ile;<\/p>\n\n\n\n<p>&#8220;&#8230;Hukukun amac\u0131 konusundaki g\u00f6r\u00fc\u015fleri, iki ana grupta \u00f6zetlemek m\u00fcmk\u00fcnd\u00fcr.<br>1) Hukukun amac\u0131 objektif nitelikteki mutlak idedir.<br>2) Hukukun amac\u0131 de\u011fi\u015fik bireylerin say\u0131s\u0131z farkl\u0131 ama\u00e7lar\u0131na hizmettir.<\/p>\n\n\n\n<p>Belirli bir yer ve zamanda uygulanmakta olan de\u011fil de uyu\u015fmazl\u0131k ve sosyal gereksinimleri adalete en uygun \u015fekilde kar\u015f\u0131layaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclen hukuka ideal hukuk veya do\u011fal hukuk ad\u0131 verilmektedir.<\/p>\n\n\n\n<p>Do\u011fal hukukun d\u00fc\u015f\u00fcncesi hukuk felsefesi literat\u00fcr\u00fcn\u00fcn a\u011f\u0131rl\u0131kl\u0131 k\u0131sm\u0131nda varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcrmekte ise de bu d\u00fczenin kesin bi\u00e7imde form\u00fcle edilmesi \u00e7ok g\u00fc\u00e7t\u00fcr. Hukukun baz\u0131 olgusal durumlar\u0131 hedefledi\u011fi veya baz\u0131 olgusal durumlar\u0131n yaln\u0131zca e\u011fer baz\u0131 davran\u0131\u015f kurallar\u0131n\u0131 genel olarak itaat edilirse belirece\u011fi fikrini, \u00f6zellikle yak\u0131n d\u00f6nem bilim adamlar\u0131n\u0131n &#8216;\u015feylerin tabiat\u0131&#8217; taraf\u0131ndan belirlenmi\u015f hukuk kavram\u0131nda a\u00e7\u0131klanm\u0131\u015f buluruz. Bu, hukukun &#8216;ampirik&#8217; veya tecr\u00fcbi bir bilim olu\u015fu temel varsay\u0131m\u0131 \u00fczerindeki \u0131srardan kaynaklanmaktad\u0131r. Fakat \u00f6zg\u00fcl h\u00e2lini hi\u00e7 kimsenin tahmin edemeyece\u011fi ve hi\u00e7 kimsenin kesin olarak tan\u0131mlanamayaca\u011f\u0131 \u00f6zellikler taraf\u0131ndan belirlenen b\u00f6ylesi bir soyut d\u00fczeni bir gaye olarak tasavvur etmek \u00e7o\u011fu ki\u015finin uygun ve rasyonel eylem hedefi olarak d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fc \u015fey ile uyumsuzdu. \u0130nsanlar aras\u0131 ili\u015fkilerin soyut oldu\u011fu veya s\u00fcrekli de\u011fi\u015fti\u011fi b\u00f6ylesi bir kozmos d\u00fczeninin idamesi, insanlar\u0131n tasar\u0131ml\u0131 eyleminin amac\u0131, hedefi veya sonucundan anlad\u0131klar\u0131 \u015feye uymad\u0131.<\/p>\n\n\n\n<p>Ama\u00e7 kavram\u0131ndan; hukukun de\u011fi\u015fik bireylerin say\u0131s\u0131z ama\u00e7lar\u0131na hizmet etti\u011fini anl\u0131yoruz. O, \u00f6nceden \u00f6ng\u00f6r\u00fclemeyen \u00e7ok say\u0131da farkl\u0131 ama\u00e7lar i\u00e7in ara\u00e7lar sa\u011flar. Hukuk herhangi bir amac\u0131n arac\u0131 de\u011fildir. Sadece \u00e7ok say\u0131daki amac\u0131n ba\u015far\u0131yla izlenmesinin bir \u015fart\u0131d\u0131r. O, muhtemelen lisan\u0131n ard\u0131ndan, en \u00e7ok say\u0131daki farkl\u0131 amaca hizmet eden ikinci ara\u00e7t\u0131r. Hukuk kesinlikle bilinen bir ama\u00e7 i\u00e7in yap\u0131lmam\u0131\u015ft\u0131r. Ona g\u00f6re hareket eden insanlar\u0131 ama\u00e7lar\u0131n\u0131n takibini daha ba\u015far\u0131l\u0131 k\u0131lmas\u0131 sayesinde geli\u015fmi\u015ftir.<br>Bu durumda; yarg\u0131\u00e7tan muhafaza etmesi beklenen, faaliyet h\u00e2lindeki bireylerin kimi beklentilerinin, ba\u015fkalar\u0131n\u0131n m\u00fcdahalesinden korunuyor olmas\u0131na dayanan bir d\u00fczenin varl\u0131\u011f\u0131d\u0131r.<\/p>\n\n\n\n<p>Yarg\u0131c\u0131n genellikle insanlar\u0131n adil olarak d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fc \u015feye kar\u015f\u0131l\u0131k gelecek \u015fekilde karar vermesi beklenir. Fakat o bazen Prima Facie (g\u00f6r\u00fcn\u00fc\u015fte) adil olan\u0131n me\u015fru beklentileri hayal k\u0131r\u0131kl\u0131\u011f\u0131na u\u011fratmas\u0131 y\u00fcz\u00fcnden, adil olmayabildi\u011fine de karar vermek zorunda kalabilir.<\/p>\n\n\n\n<p>Bu durumda o h\u00fck\u00fcmlerini m\u00fcnhas\u0131ran ifade edilmi\u015f kaziyelere de\u011fil, sosyal d\u00fczenin gereklerine dayanan ve toplum taraf\u0131ndan genel kabul g\u00f6rm\u00fc\u015f adalet anlay\u0131\u015f\u0131n\u0131n sonucu olan bir t\u00fcr &#8216;durumsal mant\u0131\u011fa&#8217; dayand\u0131rmak zorundad\u0131r.<\/p>\n\n\n\n<p>Yarg\u0131c\u0131n ba\u015flama noktas\u0131 h\u00e2lihaz\u0131rda yerle\u015fik kurallara dayal\u0131 beklentiler olacakken, \u00e7o\u011fu defa ayn\u0131 derecede iyi niyetle benimsenen ve kabul edilen, kurallar taraf\u0131ndan e\u015fit derecede tavsif edilmi\u015f, \u00e7at\u0131\u015fma h\u00e2lindeki beklentilerden hangilerinin me\u015fru telakki edileceklerine karar vermek mecburiyetinde olacakt\u0131r.<\/p>\n\n\n\n<p>Ancak bu gibi durumlarda ona yol g\u00f6sterecek hi\u00e7bir bilinen kural olmayacak olmas\u0131na ra\u011fmen yarg\u0131\u00e7 yine de istedi\u011fi tarzda karar vermekte serbest olmayacakt\u0131r. Karar, kabul edilmi\u015f kurallardan mant\u0131ki olarak \u00e7\u0131kar\u0131lmasa dahi yine de mevcut yerle\u015fik kurallar heyeti ile bu kurallar\u0131n hizmet etti\u011fi d\u00fczenin ayn\u0131s\u0131na hizmet etme anlam\u0131nda tutarl\u0131 olmal\u0131d\u0131r.<br>E\u011fer yarg\u0131\u00e7 bir davac\u0131n\u0131n bir kural\u0131n o kural yayg\u0131n bir \u015fekilde kabul edilmi\u015f ve hatta ifade edildi ise, cihan\u015f\u00fcmul olarak tasdik edilmi\u015f olsa da kendisinin beklentilerini \u015fekillendirmekte yanl\u0131\u015f oldu\u011funu d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcn\u00fc g\u00f6r\u00fcrse bu, yarg\u0131c\u0131n o kural\u0131n baz\u0131 durumlarda di\u011fer kurallara dayanan beklentilerle \u00e7at\u0131\u015ft\u0131\u011f\u0131n\u0131 ke\u015ffetmesi sayesinde olacakt\u0131r.<\/p>\n\n\n\n<p>&#8216;Biz hepimiz bunun adil bir kural oldu\u011funu d\u00fc\u015f\u00fcnm\u00fc\u015ft\u00fck fakat \u015fimdi gayriadil oldu\u011fu ortaya \u00e7\u0131kmaktad\u0131r&#8217; ifadesi i\u00e7in de bizim bir kural\u0131n adilli\u011fi veya gayriadilli\u011fi mefhumumuzun sadece bir kanaat ya da hissedi\u015f meselesinden ibaret olmad\u0131\u011f\u0131n\u0131 fakat ba\u011fl\u0131 oldu\u011fumuz bir var olan d\u00fczeni icaplar\u0131na ba\u011fl\u0131 oldu\u011funu a\u00e7\u0131k\u00e7a ortaya \u00e7\u0131kt\u0131\u011f\u0131 bir tecr\u00fcbeyi tasvir eder anlam\u0131nda bir ifadedir.<\/p>\n\n\n\n<p>B\u00f6yle bir durumda davac\u0131lar\u0131n g\u00fcvendi\u011fi kurallar\u0131n\u0131n birinin veya hatta her ikisinin tadil edilmesinin gerekecek olmas\u0131n\u0131n sebebi onlar\u0131n belirli bir durumda uygulanmas\u0131n\u0131n me\u015fakkatli olmas\u0131 veya belirli bir durumda ba\u015fka bir sonucun daha arzuya \u015fayan olmas\u0131 de\u011fildir, fakat kurallar\u0131n \u00e7at\u0131\u015fmay\u0131 \u00f6nlemeye yetersiz oldu\u011funun ispatlanmas\u0131d\u0131r. Hayek, Hukuk, Yasama ve \u00d6zg\u00fcrl\u00fck, \u0130\u015f Bankas\u0131 K\u00fclt\u00fcr Yay\u0131nlar\u0131 s. 146 vd.)<br>Burada tadil edilmesi gereken kural hukuk sistemimizde \u015f\u00fcphesiz emredici hukuk normlar\u0131 olmayacakt\u0131r. \u00c7\u00fcnk\u00fc altyap\u0131s\u0131 itibar\u0131yla K\u0131ta Avrupas\u0131 hukuk sistemine dayal\u0131 kodifike edilmi\u015f hukuk sistemimiz buna uygun de\u011fildir.<\/p>\n\n\n\n<p>T\u00fcrk Yarg\u0131c\u0131n\u0131n yapmas\u0131 gereken buyurucu normun \u00e7er\u00e7evesinde kalmak kayd\u0131 ile uyu\u015fmazl\u0131\u011f\u0131 &#8216;adil&#8217; olana en uygun \u015fekilde \u00e7\u00f6zmektir.<br>Maalesef hukuk sistemimizde biz yarg\u0131\u00e7lar; mahkemelerin \u00fczerinde bulunan a\u015f\u0131r\u0131 i\u015f yo\u011funlu\u011fu, g\u00f6r\u00fclecek dosya say\u0131s\u0131n\u0131n fazlal\u0131\u011f\u0131 ve zaman darl\u0131\u011f\u0131 gibi nedenlerden dolay\u0131 mahkemeler ve Y\u00fcksek mahkemede, \u00f6n\u00fcne gelen i\u015fi olu\u015fturulmu\u015f bir tak\u0131m \u015fablonlar\u0131n i\u00e7erisine hapsedip kar\u015f\u0131m\u0131zda bulunanlar\u0131n insan oldu\u011funu ve bizim verip ak\u015fama unuttu\u011fumuz kararlar\u0131n kar\u015f\u0131m\u0131zdaki bireyler \u00fczerinde derin sonu\u00e7lar\u0131 olabilece\u011fini zaman zaman g\u00f6zden ka\u00e7\u0131rabiliyoruz.<\/p>\n\n\n\n<p>Oysa Yarg\u0131tay 1. Hukuk Dairesinin dedi\u011fi gibi &#8216;H\u00e2kim, insana, tabiata, ger\u00e7e\u011fe, ola\u011fana s\u0131rt \u00e7evirmeden ve kat\u0131 kal\u0131plar i\u00e7erisine s\u0131k\u0131\u015f\u0131p kalmadan uyu\u015fmazl\u0131\u011fa insan kokusu ta\u015f\u0131yan bir \u00e7\u00f6z\u00fcm getirmek zorunlulu\u011fundad\u0131r&#8217; (Yarg\u0131tay 1. Hukuk Dairesinin 31.12.1976 tarihli ve 9370-13138 say\u0131l\u0131 ilam\u0131.)<\/p>\n\n\n\n<p>Somut olay\u0131m\u0131za gelirsek;<br>Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 taraf\u0131ndan 19.01.2014 tarihinde meydana gelen e\u015fe kar\u015f\u0131 kasten yaralama olay\u0131 nedeni ile mahkememizde san\u0131k hakk\u0131nda bir dava a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>M\u00fc\u015fteki &#8230; 19.01.2014 tarihinde poliste vermi\u015f oldu\u011fu ifadesinde san\u0131k &#8230;&#8217;ndan \u015fik\u00e2yet\u00e7i olmu\u015f ise de 23.01.2014 tarihinde poliste vermi\u015f oldu\u011fu ek ifadesinde san\u0131k &#8230;&#8217;nun kendisi hakk\u0131nda yapm\u0131\u015f oldu\u011fu \u015fik\u00e2yete istinaden kendisinin de \u015fik\u00e2yette bulundu\u011funu eski beyanlar\u0131na ek olarak san\u0131k &#8230; ile daha sonra aralar\u0131nda bir yanl\u0131\u015f anla\u015f\u0131lma oldu\u011funu anlayarak anla\u015ft\u0131klar\u0131n\u0131 ve \u015fik\u00e2yet\u00e7i olmad\u0131\u011f\u0131n\u0131 beyan etmi\u015ftir.<\/p>\n\n\n\n<p>M\u00fc\u015fteki Mahkememizde 11.06.2014 tarihinde verdi\u011fi ifadesinde &#8216;Olay tarihinde e\u015fim ile aram\u0131zda bo\u015fanma davas\u0131 vard\u0131. \u0130kimiz de birbirimize kar\u015f\u0131 \u00f6fkeli ve tav\u0131rl\u0131 idik. Olay\u0131n oldu\u011fu g\u00fcn e\u015fim ile bo\u015fanma konusunu konu\u015furken y\u00fcz\u00fcm\u00fc tuttu ve &#8216;Ne yap\u0131yorsun, yuvam\u0131z y\u0131k\u0131l\u0131yor&#8217; dedi ve bu s\u0131rada kuvvetlice s\u0131kt\u0131\u011f\u0131 i\u00e7in y\u00fcz\u00fcmde t\u0131rnak izleri olu\u015ftu. Her ne kadar eski ifademde bana sald\u0131rd\u0131\u011f\u0131n\u0131 s\u00f6ylemi\u015f isem de e\u015fim bana sald\u0131rmam\u0131\u015ft\u0131r. Bir araya geldik bo\u015fanma s\u00fcreci sona ermi\u015ftir. E\u015fim ile mutluyum \u015fik\u00e2yet\u00e7i de\u011filim&#8217; \u015feklinde beyanda bulunmu\u015ftur.<\/p>\n\n\n\n<p>M\u00fc\u015fteki &#8230; ve san\u0131k &#8230; on \u00fc\u00e7 y\u0131ld\u0131r evlidirler ve iki tane de \u00e7ocuklar\u0131 bulunmaktad\u0131r.<\/p>\n\n\n\n<p>Olay tarihinde aralar\u0131nda bo\u015fanma davas\u0131 bulunmaktad\u0131r. Hayat\u0131n ola\u011fan ak\u0131\u015f\u0131 i\u00e7erisinde bo\u015fanma a\u015famas\u0131nda bulunan e\u015flerin aras\u0131nda birtak\u0131m tart\u0131\u015fmalar\u0131n ve gerginliklerin olmas\u0131 ka\u00e7\u0131n\u0131lmazd\u0131r. Bu durumda muhatap olan \u00e7iftlerin normal zamanlardaki gibi olaylar kar\u015f\u0131s\u0131nda so\u011fukkanl\u0131 davranmalar\u0131 ve hareket etmeleri her zaman m\u00fcmk\u00fcn olmayabilir. Bu zaviyeden yakla\u015farak somut olay\u0131m\u0131z\u0131 ele alacak olursak m\u00fc\u015fteki e\u015fi olan san\u0131\u011f\u0131n kendisinden \u015fik\u00e2yet\u00e7i olmas\u0131 hasebiyle e\u015finden \u015fik\u00e2yet\u00e7i oldu\u011funu ve konu\u015fma esnas\u0131nda e\u015finin y\u00fcz\u00fcn\u00fc kuvvetlice s\u0131kt\u0131\u011f\u0131 i\u00e7in t\u0131rnak izlerinin olu\u015ftu\u011funu ve e\u015finin kendisine sald\u0131rmad\u0131\u011f\u0131n\u0131 beyan etmi\u015ftir.<\/p>\n\n\n\n<p>San\u0131k ve m\u00fc\u015fteki aras\u0131nda daha \u00f6nceye dayanan bir husumet veya s\u00fcrekli kavga ettiklerine dair herhangi bir delil bulunmamaktad\u0131r.<br>Mahkememizce Kadero\u011flu ailesinin temelinde bulunan evlilik &#8216;kurtar\u0131lamaz evlilik&#8217; ya da &#8216;m\u00fcdahale edilmesi gereken evlilik&#8217; stat\u00fcs\u00fcnde de\u011fildir.<\/p>\n\n\n\n<p>Ailenin toplumun temeli oldu\u011fu ger\u00e7e\u011fi ve Mahkememizce s\u0131k\u00e7a da g\u00f6zlendi\u011fi gibi b\u00f6l\u00fcnm\u00fc\u015f ailelerden geriye kalan \u00e7ocuklar\u0131n \u00fczerinde meydana gelen psikolojik travma, su\u00e7a yatk\u0131nl\u0131klar\u0131 ve giderek topluma monte olamam\u0131\u015f birey h\u00e2line gelme potansiyelleri de dikkate al\u0131narak mahkememiz kurtar\u0131lamaz ya da m\u00fcdahale edilmesi gereken evlilik niteli\u011fi kazanmam\u0131\u015f ailelerin b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn sa\u011flanmas\u0131 i\u00e7in san\u0131\u011f\u0131n lehine olan b\u00fct\u00fcn hukuksal d\u00fczenlemelerin g\u00f6ze al\u0131nmas\u0131 gerekti\u011fi d\u00fc\u015f\u00fcncesindedir.<br>Keza h\u00e2kim \u00f6n\u00fcne gelen olay ile ilgili bazen yerle\u015fik uygulamalar\u0131n aksine adil olan\u0131 saptay\u0131p karar vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n<p>Onar\u0131c\u0131 adalet ilkesi gere\u011fi yarg\u0131lama sadece ge\u00e7mi\u015fe y\u00f6nelik olarak de\u011fil gelece\u011fe de y\u00f6nelik olmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Somut olay\u0131m\u0131zda da m\u00fc\u015fteki &#8230;&#8217;nun Mahkememizde ifade etti\u011fi &#8216;Ben e\u015fim ile bar\u0131\u015ft\u0131m, san\u0131k e\u015fim yuvam\u0131z y\u0131k\u0131l\u0131yor, kendine gel diyerek y\u00fcz\u00fcm\u00fc s\u0131km\u0131\u015ft\u0131, ben de y\u00fcz\u00fcm\u00fc aniden geriye \u00e7ekince \u00e7izikler olu\u015ftu, san\u0131kta yaralama kast\u0131 yoktu, bir anl\u0131k k\u0131zg\u0131nl\u0131kla \u015fik\u00e2yet\u00e7i oldum. hakk\u0131nda d\u00fczenlenen 27.01.2014 tarihli raporda; darp nedeniyle ba\u015fvuran ma\u011fdurun y\u00fcz\u00fcnde, her iki yanakta, \u00e7ok say\u0131da \u00e7izik tarz\u0131nda t\u0131rnak iziyle uyumlu dermabrazyon izlendi\u011fi, ma\u011fdurdaki mevcut yaralanman\u0131n ya\u015fam\u0131n\u0131 tehlikeye sokmad\u0131\u011f\u0131, basit bir t\u0131bbi m\u00fcdahale ile giderilebilecek \u00f6l\u00e7\u00fcde hafif nitelikte oldu\u011funun belirtildi\u011fi,<\/p>\n\n\n\n<p>Ma\u011fdur &#8230; 19.01.2014 tarihinde Kollukta; \u00f6\u011fretmen oldu\u011funu, san\u0131kla evli olduklar\u0131n\u0131, m\u00fc\u015fterek iki \u00e7ocuklar\u0131n\u0131n bulundu\u011funu, e\u015finin son zamanlarda evde bira i\u00e7meye ba\u015flad\u0131\u011f\u0131n\u0131, \u00e7ocuklar\u0131na ilgi g\u00f6stermedi\u011fini, bunun \u00fczerine san\u0131\u011f\u0131 bira i\u00e7memesi, \u00e7ocuklar\u0131na \u015fefk\u00e2t g\u00f6stermesi, davran\u0131\u015flar\u0131n\u0131 de\u011fi\u015ftirmesi hususunda uyard\u0131\u011f\u0131n\u0131, san\u0131\u011f\u0131n bu tav\u0131rlar\u0131n\u0131 s\u00fcrd\u00fcrmesi nedeniyle bo\u015fanma davas\u0131 a\u00e7t\u0131\u011f\u0131n\u0131, davay\u0131 \u00f6\u011frenen san\u0131\u011f\u0131n yirmi g\u00fcn kadar \u00f6nce m\u00fc\u015fterek evlerini terk ederek annesinin evine yerle\u015fti\u011fini, olay g\u00fcn\u00fc k\u00fc\u00e7\u00fck \u00e7ocu\u011funu san\u0131\u011fa b\u0131rakmaya gitti\u011fi s\u0131rada, san\u0131\u011f\u0131n kendisine hakaret ederek sald\u0131rd\u0131\u011f\u0131n\u0131, san\u0131ktan \u015fik\u00e2yet\u00e7i oldu\u011funu, uzla\u015fmak istemedi\u011fini,<\/p>\n\n\n\n<p>23.01.2014 tarihli ek ifadesinde; san\u0131k ile aralar\u0131nda ya\u015fananlar\u0131n yanl\u0131\u015f anla\u015f\u0131lmadan kaynakland\u0131\u011f\u0131n\u0131, san\u0131kla anla\u015ft\u0131\u011f\u0131n\u0131, \u015fik\u00e2yetinin bulunmad\u0131\u011f\u0131n\u0131,<\/p>\n\n\n\n<p>Mahkemede; olay tarihinde san\u0131\u011fa kar\u015f\u0131 a\u00e7t\u0131\u011f\u0131 bo\u015fanma davas\u0131n\u0131n derdest oldu\u011funu, bu nedenle birbirlerine kar\u015f\u0131 \u00f6fkeli olduklar\u0131n\u0131, olay g\u00fcn\u00fc san\u0131kla bo\u015fanma konusunu konu\u015furken san\u0131\u011f\u0131n y\u00fcz\u00fcn\u00fc tutarak &#8220;Ne yap\u0131yorsun, yuvam\u0131z y\u0131k\u0131l\u0131yor&#8221; dedi\u011fini, san\u0131k kuvvetlice s\u0131kt\u0131\u011f\u0131 i\u00e7in y\u00fcz\u00fcnde t\u0131rnak izleri olu\u015ftu\u011funu, ancak ilk ifadesinin aksine san\u0131\u011f\u0131n kendisine sald\u0131rmad\u0131\u011f\u0131n\u0131, bar\u0131\u015ft\u0131klar\u0131n\u0131, yeniden bir araya geldiklerini, san\u0131kla ya\u015famaktan mutlu oldu\u011funu, \u015fik\u00e2yet\u00e7i olmad\u0131\u011f\u0131n\u0131, ifade etmi\u015ftir.<\/p>\n\n\n\n<p>San\u0131k &#8230; 19.01.2014 tarihinde Kollukta \u015fik\u00e2yet\u00e7i s\u0131fat\u0131yla al\u0131nan ifadesinde; \u00f6\u011fretmen olarak g\u00f6rev yapt\u0131\u011f\u0131n\u0131, ma\u011fdurla 13 y\u0131ld\u0131r evli oldu\u011funu, m\u00fc\u015fterek iki \u00e7ocuklar\u0131n\u0131n bulundu\u011funu, Aral\u0131k ay\u0131n\u0131n son g\u00fcnlerinden beri ma\u011fdurla ayr\u0131 ya\u015fad\u0131klar\u0131n\u0131, ma\u011fdurla aralar\u0131nda \u00e7e\u015fitli sorunlar bulundu\u011funu, ma\u011fduru terk ederek annesinin evine gitti\u011fini, ma\u011fdurun kendisini tehdit etti\u011fini, ma\u011fdurdan \u015fik\u00e2yet\u00e7i oldu\u011funu,<br>23.01.2014 tarihli ek ifadesinde; ma\u011fdur hakk\u0131ndaki \u015fik\u00e2yetinden vazge\u00e7ti\u011fini, aralar\u0131ndaki anla\u015fmazl\u0131klar\u0131 \u00e7\u00f6zd\u00fcklerini, kar\u015f\u0131l\u0131kl\u0131 olarak anla\u015ft\u0131klar\u0131n\u0131,<\/p>\n\n\n\n<p>Mahkemede; olay tarihinde ma\u011fdurla aralar\u0131nda derdest bo\u015fanma davas\u0131 bulundu\u011funu, bu nedenle gergin olduklar\u0131n\u0131, ma\u011fdurla ya\u015fanan tart\u0131\u015fma s\u0131ras\u0131nda ma\u011fduru y\u00fcz\u00fcnden tutarak &#8220;Ne yap\u0131yorsun, yuvam\u0131z y\u0131k\u0131l\u0131yor&#8221; dedi\u011fini, ma\u011fdurun y\u00fcz\u00fcndeki t\u0131rnak izlerinin bu s\u0131rada meydana gelmi\u015f olabilece\u011fini, duygusal tepki g\u00f6sterdi\u011fini, ma\u011fduru kasten yaralamad\u0131\u011f\u0131n\u0131, su\u00e7suz oldu\u011funu, savunmu\u015ftur.<\/p>\n\n\n\n<p>Kasten yaralama su\u00e7u 5237 say\u0131l\u0131 TCK&#8217;n\u0131n 86. maddesinde;<br>&#8220;(1) Kasten ba\u015fkas\u0131n\u0131n v\u00fccuduna ac\u0131 veren veya sa\u011fl\u0131\u011f\u0131n\u0131n ya da alg\u0131lama yetene\u011finin bozulmas\u0131na neden olan ki\u015fi, bir y\u0131ldan \u00fc\u00e7 y\u0131la kadar hapis cezas\u0131 ile cezaland\u0131r\u0131l\u0131r.<br>(2) Kasten yaralama fiilinin ki\u015fi \u00fczerindeki etkisinin basit bir t\u0131bb\u00ee m\u00fcdahaleyle giderilebilecek \u00f6l\u00e7\u00fcde hafif olmas\u0131 h\u00e2linde, ma\u011fdurun \u015fik\u00e2yeti \u00fczerine, d\u00f6rt aydan bir y\u0131la kadar hapis veya adl\u00ee para cezas\u0131na h\u00fckmolunur<br>(3) Kasten yaralama su\u00e7unun;<br>a) \u00dcstsoya, altsoya, e\u015fe veya karde\u015fe kar\u015f\u0131,<br>b) Beden veya ruh bak\u0131m\u0131ndan kendisini savunamayacak durumda bulunan ki\u015fiye kar\u015f\u0131,<br>c) Ki\u015finin yerine getirdi\u011fi kamu g\u00f6revi nedeniyle,<br>d) Kamu g\u00f6revlisinin sahip bulundu\u011fu n\u00fcfuz k\u00f6t\u00fcye kullan\u0131lmak suretiyle,<br>e) Sil\u00e2hla,<br>\u0130\u015flenmesi h\u00e2linde, \u015fik\u00e2yet aranmaks\u0131z\u0131n, verilecek ceza yar\u0131 oran\u0131nda art\u0131r\u0131l\u0131r&#8221; \u015feklinde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p>Maddenin birinci f\u0131kras\u0131nda kasten yaralama su\u00e7unun tan\u0131m\u0131 yap\u0131lm\u0131\u015f, ki\u015finin v\u00fccuduna ac\u0131 veren veya sa\u011fl\u0131\u011f\u0131n\u0131n ya da alg\u0131lama yetene\u011finin bozulmas\u0131na neden olan her davran\u0131\u015f, yaralama olarak kabul edilmi\u015f, madde gerek\u00e7esinde bu husus a\u00e7\u0131k\u00e7a vurgulanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Kasten yaralama su\u00e7unda korunan hukuki yarar, ki\u015finin v\u00fccut dokunulmazl\u0131\u011f\u0131 ve beden b\u00fct\u00fcnl\u00fc\u011f\u00fcd\u00fcr. Su\u00e7un konusu, ma\u011fdurun ac\u0131 verilen veya bozulan bedeni veya ruhsal varl\u0131\u011f\u0131d\u0131r. Failin yapt\u0131\u011f\u0131 hareket sonucu, maddede belirtilen sonu\u00e7lardan biri meydana gelirse, kasten yaralama su\u00e7unun olu\u015faca\u011f\u0131nda teredd\u00fct bulunmay\u0131p, bu sonu\u00e7lar\u0131 do\u011furmaya elveri\u015fli her t\u00fcrl\u00fc hareketle kasten yaralama su\u00e7unun i\u015flenmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p>\u00d6te yandan; T.C. Anayasas\u0131&#8217;n\u0131n &#8220;Mahkemelerin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131&#8221; ba\u015fl\u0131kl\u0131 138. maddesinin birinci f\u0131kras\u0131nda;<br>&#8220;Hakimler, g\u00f6revlerinde ba\u011f\u0131ms\u0131zd\u0131rlar; Anayasaya, kanuna ve hukuka uygun olarak vicdan\u0131 kanaatlerine g\u00f6re h\u00fck\u00fcm verirler.&#8221; h\u00fckm\u00fc getirilmi\u015ftir.<\/p>\n\n\n\n<p>H\u00e2kimler kanuna g\u00f6re adalet da\u011f\u0131t\u0131rlar, h\u00e2kim kanunu be\u011fendi\u011fi veya adil buldu\u011fu i\u00e7in de\u011fil, i\u00e7inde bulundu\u011fu ceza hukuku d\u00fczeninde var olan \u00e7\u0131kar \u00e7at\u0131\u015fmalar\u0131n\u0131 ve dolay\u0131s\u0131yla irade uyu\u015fmazl\u0131klar\u0131n\u0131 \u00e7\u00f6zmek \u00fczere usul\u00fcne uygun olarak konulmu\u015f ve y\u00fcr\u00fcrl\u00fckte olan be\u015feri davran\u0131\u015f kural\u0131 olan ceza normunu, salt bu niteli\u011finden dolay\u0131 yani usul\u00fcne uygun olarak konulmu\u015f &#8220;Kanun&#8221; olma niteli\u011finden dolay\u0131 uygulamak zorundad\u0131r.
